These Terms of Service ("Terms") govern your access to and use of SurfPostings ("SurfPostings," "we," "us"). By creating an account or using the site, you agree to these Terms. If you do not agree, please do not use SurfPostings.
1. What SurfPostings Is
SurfPostings is a zero-commission online marketplace that connects people who list surf-related properties (for sale or rent) with people interested in them. We are a neutral venue. We do not own, sell, rent, manage, inspect, or appraise any property, and we are not a party to, broker of, or agent in any transaction or communication between users. Any agreement you reach with another user is solely between you and that user.
2. Eligibility and Accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate account information and a valid email address, which you must verify before using account features.
- You are responsible for safeguarding your password and for all activity under your account, and must notify us promptly of any unauthorized use.
3. Listings and Your Content
If you post a listing or other content, you are solely responsible for it and represent that it is accurate and lawful and that you have the right to offer the property and to post the content. Property details are supplied by users; we do not verify listings, properties, or the identity of users, and we do not guarantee accuracy, availability, or quality.
You keep ownership of the content you submit. You grant SurfPostings a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt (including translating it into other languages), publish, and display that content in order to operate and promote the marketplace. You may remove your listing at any time; this license ends when you do, except for content we must retain for legal or safety reasons (see Section 6).
4. Acceptable Use and Fair Housing
You agree not to use SurfPostings to:
- break any applicable law or regulation, or post unlawful, fraudulent, or infringing content;
- post content that is false, misleading, harassing, abusive, or harmful;
- scrape, overload, probe, or interfere with the security or operation of the service; or
- misuse the contact features to send spam or unsolicited solicitations.
Fair Housing and non-discrimination. SurfPostings supports equal opportunity in housing. You may not post any listing, statement, or preference, or take any action, that discriminates against or expresses a limitation or preference based on race, color, religion, sex, gender, sexual orientation, familial status, national origin, disability, or any other characteristic protected by applicable law.
5. Contacting Other Users
When you submit an inquiry, we pass your message and the contact details you provide to the relevant lister so they can respond. Use any contact information you receive only to communicate about the listing — not for marketing or any unlawful purpose.
6. Moderation, Reporting, and Removal
To keep the marketplace safe, we may review, hold, remove, or quarantine any listing or content, and may suspend or terminate accounts, at our discretion — for example, where content violates these Terms or the law. Anyone can report a listing. We retain records associated with reported or removed content for safety, dispute-resolution, and legal-compliance purposes. Where content involves suspected child sexual abuse material or other illegal material, we preserve it and report it to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law (including 18 U.S.C. § 2258A) and do not delete it on request. 7. Intellectual Property
The SurfPostings name, logo, and the site's design, text, and software are owned by SurfPostings or its licensors and are protected by law. Except for your own content, you may not copy, modify, distribute, or create derivative works from the service without our permission.
8. Disclaimers
The service and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free. See our Disclaimer for important details about property information and professional advice.
9. Limitation of Liability
To the fullest extent permitted by law, SurfPostings will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the service, your dealings with other users, or your reliance on any listing or content.
10. Indemnification
You agree to indemnify and hold SurfPostings harmless from claims, losses, and expenses arising out of your content, your use of the service, or your violation of these Terms or of any law or third-party right.
11. Termination
You may stop using SurfPostings at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or to protect the service or its users. Provisions that by their nature should survive termination — including Sections 3, 6, 8, 9, and 10 — will survive.
12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. You agree that the exclusive jurisdiction and venue for any dispute arising out of or relating to these Terms or your use of SurfPostings will be the state and federal courts located in the State of Florida, and you consent to personal jurisdiction there.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and significant changes will be communicated as required by law. Your continued use after changes take effect means you accept the updated Terms.
